IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE TOTAL AMOUNT PAID BY YOU TO REVIVE X POUCH CO. IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the limitation of liability for certain types of damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

9. Indemnification

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of our products shall first be attempted to be resolved through good-faith negotiation. If resolution is not achieved within thirty (30) days, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association rules, with proceedings conducted in North Carolina.

YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION LAWSUIT OR REPRESENTATIVE PROCEEDING against Revive X Pouch Co.

12. Severability & Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, Shipping Policy, and Return Policy, constitute the entire agreement between you and Revive X Pouch Co. regarding your use of our website and purchase of our products.
